Professionalism Tip: Respect for the Public When Working
Expired or FSBO Listings.
Soliciting business from expired or FSBO listings can be a
lucrative market niche if handled professionally. In addition to the
respect owed to other REALTORS in Article 16 of the Code of Ethics,
REALTORS are wise to adhere to the consumer protection laws
concerning telephone solicitation.
State and federal laws prohibit telephone solicitation of
consumers who have protected their phone numbers by placing them on
the appropriate Do Not Call list. REALTORS soliciting listings are
covered by these laws. If a home owner has placed their number on
the Do Not Call list a licensee may not telephone them to inquire
about or make an offer to provide real estate services.
It is believed that there is a very limited exception to his
rule when a FSBO owner has placed a sale sign or other advertisement
with phone number. It is believed that a licensee would be protected
IF he or she has a legitimate buyer for the FSBO property
where the phone number is advertised. To the best of our knowledge,
this belief has not been tested in the courts nor has it been
approved by the various governing bodies. Licensees are advised to
proceed with caution.

FAA Plan Discussed in Delco
Delaware County residents opposing the Federal Aviation
Administration’s plan to redirect air traffic, held a public meeting
earlier this week at the Ramada Inn. Those in attendance voiced
concerns about possible negative affects to their quality of life as
a result of this change. Implementation of the proposed plan would
not begin for at least five years, but residents and township
leaders feel that if the FAA allows planes departing from the
airport to make a right-hand turn sooner from the Delaware River,
fully loaded planes will be right above neighborhoods, schools,
hospitals and nursing homes. The county
website has an on line petition to oppose the plans for the
current airport expansion and another town meeting is scheduled for
Thursday, September 28 at the Country Squire in Broomall from 8:30
a.m. to 10:30 a.m.
Stay tuned to the REALTORS Legislative Alliance’s weekly News
Briefs for continued coverage of the FAA expansion. Not receiving
