Office Closed on Thursday, November 24 and Friday, November 25
Building Please be advised that the Suburban West REALTORS Association office will be closed next Thursday and Friday (November 24 and November 25) in observance of the Thanksgiving Holiday. Members requiring assistance from staff should contact the office prior to 4 p.m. on Wednesday, November 23. The office will reopen Monday, November 28 at 8:00 a.m.

Changes to Code of Ethics
During the recent Conference and Expo in San Francisco, The National Association of REALTORS Board of Directors approved three Professional Standards changes within the Code of Ethics effective January 1, 2006. The following are an explanation of those changes:

Standard of Practice 1-13 was amended to say, when REALTORS are working with buyers or tenants, they should tell their clients that “sellers or sellers’ representatives may not treat the existence, terms, or conditions of offers as confidential unless confidentiality is required by law, regulation, agreement between the parties.”

Standard of Practice 1-15 was amended to say, in response to inquiries from buyers or cooperating brokers, REALTORS shall, with the sellers’ approval, disclose the existence of other offers and also, when disclosure is authorized, whether the offer came from the listing licensee, another licensee in that company, or a cooperating broker.

Clarification was made to Article 10 regarding the ethical issues when providing demographic data in a residential or commercial transaction. However, the Pennsylvania Human Relations Act (PHRA) controls more strictly the dissemination of certain demographic information than does federal law and the Code of Ethics. The PHRA makes it illegal for any person to keep and use demographic data that includes entries pertaining to race, color, religious creed, ancestry, sex, national origin, handicap, disability, and the use/training of guide or support animals in connection with the sale or lease of housing and commercial property.

Narberth Property Tax Increase Expected
Narberth residents are expected to face their fifth consecutive year in property tax increase. The 2006 preliminary budget includes an increase from 6.5299 mills to 6.957mills. The last time the council held the line on tax increase was in 2001, when the tax rate was 4.18 mils. Borough Manager Bill Martin said it is possible the tax rate will not be increased in the final budget. Every year for the past four years, the final tax increase has been smaller than the initial increase the preliminary budget predicted. Other budget increases include a hike in the trash collection fee from $180,000 to $270,366. Charles Blosewski, who is contracted for the trash collection services, cited increases in insurance, gas and labor costs as reasons for the increase. Blosewski is the only company that submitted a bid for the contract when bids were open. (Source: Main Line Times; 11/17/2005)

Team Advertising: Proceed With Caution
Yellow Light By the strictest interpretation of the Real Estate Licensing and Registration Act, team advertising is PROHIBITED. A firm or licensee may only advertise using the name as shown on the real estate license. Teams are not licensed entities and therefore such advertising would be misleading to the consumer. However, in 1998, the Real Estate Commission, after receiving numerous requests and persuasive arguments, adopted a guideline to allow team advertising. A team may advertise as such provided the following four criteria are strictly followed:

  • In addition to the team name, all licensed individuals associated with the team must be listed in the advertisement.
  • Unlicensed individuals, including assistants may not be listed as members of the team.
  • Licensees on a team must be within the same real estate company.
  • The requirements of Section 35.305 of the licensing act, “Business name on advertisements” must be met.

The only exception to the above is business cards. An individual team member may have a business card that does not include the names of all licensed individuals on the team.

Toll Brothers Housing Plan Gets Final OK in Upper Uwchlan
The board of supervisors granted final approval Monday night to Toll Brothers’ plans to develop 255 housing units on a 139-acre tract of land, known as the Ewing tract. The development overlaps into West Vincent, where more than 200 homes are planned. The supervisors approved Toll Brothers’ revised plans with the provisos that it adhere to every recommendation from the township’s various consultants, that it not remove 1.5 acres of environmentally sensitive woodlands as was planned and that it maintain a circular road design. Regulations Changes At Hilltop Condominium in Brookhaven
On August 27, 2003, the Hilltop Condominiums Association in Brookhaven amended their by-laws to prohibit owning dogs in the community with the exception of existing dogs, which were grandfathered and registered at the time. Because of this clause, there is some confusion as REALTORS and/or clients looking to move into the community are erroneously believing they too can own dogs in the community. The Community requests that REALTORS who are either listing units or assisting buyers with units in the community make their client aware of this regulation. Reminders
Toy Drive in December—The Suburban West REALTORS Association is pleased to continue to coordinate an effort among our members to donate toys to underprivileged children in our metropolitan area. Beginning November 28, all members are encouraged to bring at least one new unwrapped, non-violent toy to the Association’s office in Malvern (Suite 240). The organization will continue to accept donated toys through Friday, December 16. All gifts that we receive will be distributed to deserving children and families through three organizations: Dreuding Center (Project Rainbow), Head Start and the Weatherly Day Center. Free Education for REALTORS—All REALTOR Members of the Suburban West REALTORS Association have received an education voucher included with their 2006 dues invoice packet mailed this week. This voucher allows the member to attend a complimentary $35 MCE class between January 1, 2006 and December 31, 2006 (NOTE that designation and certificate courses are excluded). Due to the success of the Association’s merger, we are pleased to leverage our resources to make this free registration available to our 4,700 REALTORS. To utilize the voucher, members simply need to notify the staff at the time of registration of their intent to redeem your free registration. Note that this can be accomplished via phone or paper registration—you cannot use the voucher if you are registering on-line. Each member is only eligible to receive one free class and must pay their 2006 dues prior to use of the voucher. A comprehensive list of school courses can be accessed here.
